1. Introduction and Acceptance
Welcome to Froodly.ca. By accessing and using our website, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you should not use our services.
2. Account Creation
You may create an account to place orders, save delivery addresses, and view your order history. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
3. Product Information and Pricing
We strive to provide accurate product descriptions and pricing. However, we do not warrant that product descriptions or other content are entirely error-free. Prices are subject to change without notice.
4. Orders, Payments, and Delivery
Order Acceptance: Your order constitutes an offer to buy a product. All orders are subject to acceptance by Froodly.
Payments: Payments are processed securely by Stripe. By submitting your payment information, you authorize Stripe to charge your designated payment method.
Delivery Area: We only deliver to specific postal codes within the GTA. We will verify your postal code during checkout.
Delivery Process: We use our own delivery team. You will be able to select an available delivery time slot during checkout. We are not responsible for delays outside of our reasonable control.
Risk of Loss: The risk of loss and title for products pass to you upon our delivery of the products to the address you provided.
5. Returns, Refunds, and Cancellations
Freshness Guarantee: We guarantee the freshness of our produce. If you are not satisfied with an item, please contact us within 24 hours of delivery with a photo.
Cancellations: Orders can be modified or canceled up to 48 hours before the delivery time.
Refunds: Refunds are issued at our discretion and will be processed back to the original payment method.
6. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Froodly and is protected by copyright and intellectual property laws. You may not use any content from our site without our express written permission.
7. Limitation of Liability and Disclaimers
Froodly, its employees, and affiliates will not be liable for any damages of any kind arising from the use of this website or our products. Our services and products are provided "as is" and "as available" without any warranties of any kind.
8. Governing Law
These Terms and Conditions are governed by the laws of the Province of Ontario, Canada.
